Trillanes seeks probe on water-tax issue

Senator Antonio “Sonny” F. Trillanes files Senate Resolution No. 33, seeking a Senate investigation into the alleged act of water concessionaires of passing on their corporate income taxes and other expenses to consumers.
 
Trillanes said that: “It is the policy of the State to protect the interest and promote the welfare of consumers against abuses from businesses, companies and industries as well as from their questionable practices. However, it appears that the Metropolitan Waterworks and Sewerage System (MWSS) Regulatory Office directly contravened this declared state policy when it issued a resolution allowing Manila Water and Maynilad to recover their corporate income tax payments, among other expenses, by passing these on to their consumers.”
 
According to consumer advocacy groups, MWSS issued in  2004 Resolution No. 04-006-CA which permitted the concessionaires to transfer the burden of paying their corporate income taxes to their the customers. It was also revealed that from 2008 to 2012, consumers have been shouldering about P 1.5 Billion and P1.6 Billion annually in taxes for Manila Water Company, Inc. and Maynilad Water Services, respectively, over the past five (5) years or some 15.3 Billion Pesos in total. Apart from their corporate income taxes, the water concessionaires have also allegedly passed on other charges to consumers, including their travel and entertainment expenses, advertisements, donations, training expenses and even expenses for flowers.
 
“These actions also contradict the Supreme Court’s landmark decision, involving power distribution firm Manila Electric Co., where the Supreme Court expressly declared that the burden of paying corporate income taxes should not be unjustly borne by consumers but by the party maintaining the facility,” he added.
 
“It is important that investigations must be conducted immediately in order to look into the propriety of this controversial arrangement approved by the MWSS, with the end in view of enacting remedial legislation to strengthen existing laws in order to protect the welfare of Filipino consumers” Trillanes stated in the Resolution. #

Trillanes nais paimbestigahan ang P15.3 bilyong water-tax isyu
Nais paimbestigahan ni Senador Antonio " Sonny" F. Trillanes IV ang 'di umano'y pagpasa ng mga water concessionaires ng kanilang corporate income taxes at iba pang buwis sa mga konsyumer. 
Sa hinaing Senate Resolution No. 33, sinabi ni Trillanes na "Polisiya ng ating pamahalaan na protektahan ang mga konsyumer sa mga abuso mula sa mga negosyo, kumpanya, at industriya, gayundin sa kanilang mga  ilegal na gawain.   Ngunit, kitang-kita ang paglabag sa nasabing polisiya ng Metropolitan Waterworks and Sewerage System (MWSS) Regulatory Office nang mag-isyu ito ng resolusyon na pumapayag na ipasa ng  Manila Water at Maynilad  ang kanilang corporate income tax, at iba pang bayarin sa ating mga konsyumer."
Ayon sa isang consumer advocacy group, ang MWSS ay nag-isyu ng 2004 Resolution No. 04-006-CA na pinapayagan ang pagpasa ng kanilang income corporate taxes sa kanilang mga konsyumer. Napagalaman din na mula 2008 hanggang 2012, ang mga konsyumer ang pumapasan sa higit kumulang P1.5 bilyon na taon-taong buwis ng Manila Water Company, Inc at P1.6 bilyon na buwis taon-taon naman ng Maynilad Water Services, o  may kabuuan na P15.3 bilyon sa loob ng limang taon. Bukod pa sa income tax, di umano ay pinapasa rin sa mga konsyumer ang kanilang travel at entertainment expenses, advertisements, mga donasyon, training expenses, pati ang gastos sa pagbili ng bulaklak. 
"Ang mga gawaing ito ay labag sa kilalang desisyon ng Supreme Court sa kaso ng Manila Electric Co., kung saan ayon Supreme Court ang pasanin ng pagbabayad ng corporate income tax ay hindi nararapat ipasa sa mga konsyumer," dagdag ni Trillanes. 
"Importante na magkaroon ng imbestigasyon upang mabusisi natin ang resolusyon na inilabas ng MWSS na nagpapahintulot sa mga water concessionaires na ipasa sa mga konsumer ang kanilang income tax, upang sa gayun ay makapaghain tayo ng nararapat na panukalang batas na magsasaayos at magpapalakas sng mga batas na nagpo-protekta sa ating mga konsyumer," ani Trillanes sa hinaing Resolusyon.#
